Photos & Copywrites
From: curiousmatt_2000 Sent: December 4, 1999 Message 1 of 9
Hi-
I noticed a message earlier mentioning copywriting concerns. Whenever you post a picture, make sure to sign it. Initals are fine. (Hopefully somewhere that can't be cropped out.) In the USA, that's all you have to do to claim copywrite. The original photographer always retains the copywrite unless they waive that right under contract. I'm a photographer so I should know. And when businesses run my photos without my consent, I send them a huge bill and sue if they don't pay it.
So don't let copywriting bullshit prevent you from uploading a cute shot of your wife in the bathtub. Blur her face and the pay sites won't touch it.

Yeah, I suppose most porn paysites are run by lowlifes. So I would just always write my website address on it. And be flattered if it goes all over the place. Free advertising for your club.

Putting your own web site address or a copyright on a pic is not a guarantee of anything. I've seen the "lowlifes" as you call them carefully remove the original text and replace it with their own.
You are right that some people don't mind their pics being spread around. I've started posting the Cindy pics to the Internet news groups myself occasionally in small quantities, and the number of hits gotten by this site always jumps by a factor of two-three the next couple of days.
But other people have a much more possessive attitude towards their pics. They are willing to share them with fellow fisters in a closed forum, but they don't want to see them being used as jerk-off material by the horny majority, and definitely don't want to see others making money on their private sex lives.
By the way, the word is "copyright", not "copywright".
Yours,
Joe

I've just had a run-in with the administrator of an Excite Club who had modified three of the Cindy pics and posted them on her club. Her modification consisted of removing the text and copyright notice.
When I discovered this and asked her to remove the pics from her club she claimed that Cindy's copyright was not enforceable because we had posted the pics on the Internet! So I had to enlist the aid of the employees of Excite Clubs to get the pics removed :-(
Here's a link which explains some of the basic misconceptions about copyrights:

hi...i was just wondering somthing...if you have pics from the internet and you post them on a free site can you still get sued?and if i had a paysite do i have to have permission to use any pics i find on the net?

> if you have pics from the internet and you post them on a free site can you still get sued?
My guess is that in theory, yes, but in reality they would first give you a warning, and if you removed the pics immediately then they would not pursue the case further.
> and if i had a paysite do i have to have permission to use any pics i find on the net?
In the case of a pay site I think you have to be even more careful. So my recommendation would be yes, you should stick to pics that you do not have any reason to believe are copyrighted, or else copyrighted pics that you have obtained permission to use.
But these are just my personal opinions. If you want to be on the safe side you should talk to someone who has more knowledge and experience about the legal implications of using pics on the Internet.
Here's an example: I believe that there was an O'Pearl fan club at Yahoo that contained a lot of O'Pearl pics. Creative Arts, the company that makes the videos and magazines that O'Pearl appears in, filed a complaint with Yahoo and got the club closed.
I know that if I ever get a complaint about any pics posted on this club then I will remove them immediately, rather than risk getting into a copyright dispute. Similarly, when I find a Cindy pic anywhere on the Internet which is in violation of our rules, I always complain and so far I have always been successful in getting the pic removed.
Joe
PS. Speaking of Cindy pics, I'm hoping that Cindy will be in the mood for a little picture-taking session this weekend :-) Unfortunately, we've been very busy lately, so I haven't had much time for this club.
